The agreement between you and Tonle.co when we build and manage your website.
Agreement to these terms
These terms apply when you use tonle.co or take a Tonle plan. By starting a site with us, or by continuing to use a site we manage for you, you agree to them.
If you do not agree, please do not use the service.
Who can use Tonle
You need to be able to enter into a contract where you live. If you are signing up for a business, a club or anyone other than yourself, you confirm you are allowed to act for them.
What Tonle does
Tonle designs, builds, publishes and looks after a website for you. We do the work; you do not need to use an editor, a builder or a login.
In practice that means we take what you send us, turn it into a site, put it online at your Tonle address, and make changes when you ask for them.
Building and managing your site
After you send the form we prepare a first preview, normally within 24 hours. You then tell us anything you want changed. When you are happy, the site goes live.
We choose the tools, structure and hosting arrangements used to deliver the service.
Your responsibilities
To keep things moving you agree to:
- give us accurate information about you or your business;
- send content you have the right to publish;
- keep your prices, hours and contact details up to date by telling us when they change;
- respond when we need something from you to finish a piece of work;
- keep your payments current.
Your content and the rights we need
Your content stays yours. Photographs, text, logos, listings and anything else you send remain your property or the property of whoever you licensed them from.
By sending us content you give Tonle permission to store it, adapt it for the web (for example resizing or cropping an image), and publish it on your site while you are a customer. We may also show a preview of your finished site in our own examples and on Explore. Tell us if you would rather we did not.
You confirm you have the rights and permissions needed for everything you send, including the permission of people who appear in photographs.
Our platform and designs
The Tonle name, the tonle.co site, our design system, templates, components and the software we use to run the service belong to Tonle. Nothing in these terms transfers ownership of them to you.
A site we build for you is delivered as part of a managed service, not as a one-off file handover. If you want to take your site elsewhere, talk to us and we will help you get your content out.
Plans and fees
Tonle currently offers paid plans including Starter at $9 per month and Growth at $39 per month. The features included in each plan are shown on the pricing section of the site at the time you sign up. Creator Program arrangements are reviewed individually and, when offered, are communicated directly to the applicant.
Prices and plan features may change. We will tell existing customers before a change affects them.
Billing
Paid plans are billed monthly and continue until you cancel. We will tell you how to pay and when payment is due when you start.
If payment stops, we may pause the service and, after a reasonable period and notice to you, take the site offline.
Growth 90-Day First Customer Guarantee
If you are a new Growth customer and you do not get your first customer within 90 days after your Growth website goes live, you can request a full refund of the Growth subscription fees you paid during those first 90 days.
The guarantee applies once per business and only to a first Growth subscription. Your Tonle site must remain live during the 90-day period, and the contact information you provide must remain accurate and reachable. Third-party costs paid outside the Growth plan, including domain registration, paid advertising, payment processing, or services paid directly to another provider, are not included in the refund.
To claim the guarantee, contact hello@tonle.co within 14 days after the 90-day period ends. Eligible Growth plan fees will be returned to the original payment method. Nothing in this guarantee limits consumer rights that cannot legally be excluded.
Update requests and fair use
Update allowances depend on your plan. Growth includes ongoing updates within the scope described below. Starter does not include ongoing website updates. Send us the change and we will make it according to your plan.
The plan covers ongoing, reasonable content and design work on the Tonle site we manage for you. Requests that amount to a new application, substantial custom software, a significant new system, or work outside the scope of the managed site may need a separate agreement and a separate price. We will always tell you before treating something as out of scope, rather than quietly declining it.
We are not trying to reduce what is offered — we are drawing a line around building you a different product.
Cancellation
You can cancel at any time by telling us. Your site stays online for the period you have paid for.
After cancellation we stop managing and hosting the site, and the Tonle address stops serving it. Ask us before you cancel if you want a copy of your content and we will provide it.
Acceptable use
You may not use Tonle to publish or do anything that is unlawful where it is published or where Tonle operates. That includes:
- fraud, phishing or deception;
- malware or anything designed to damage a device or system;
- impersonating another person or business;
- infringing someone else's copyright, trade mark or other rights;
- content that is abusive or harassing where the law prohibits it;
- spam or bulk unsolicited messaging;
- gambling or the sale of goods and services where doing so is not permitted;
- attempts to break into, overload or interfere with Tonle's systems or anyone else's.
If you are not sure whether something is allowed, ask before publishing it.
Addresses and domains
Sites are published on a Tonle subdomain such as yourname.tonle.co. The tonle.co domain belongs to Tonle, and a subdomain is provided to you as part of the service rather than sold to you.
If you use your own domain, that domain remains yours and stays registered in your name.
Availability and changes to the service
We aim to keep sites online and fast, but we do not promise uninterrupted availability. Hosting, networks and third-party services can fail, and maintenance is sometimes necessary.
We may change how the service works, add features or retire them. If a change materially reduces what you are receiving, we will tell you.
Suspension and termination
We may suspend or end the service if these terms are broken, if the content published is unlawful, if payment stops, or if continuing would expose Tonle or others to real risk. Where it is reasonable to do so, we will warn you first and give you a chance to put it right.
Backups and your data
We keep working copies of the sites we manage as part of running the service. This is operational practice, not a backup service for you, and you should keep your own copies of original photographs, logos and documents.
Third-party services and links
Your site may link to or rely on services we do not control — messaging platforms, social networks, maps, analytics. Those services have their own terms, and we are not responsible for them.
Disclaimers
Tonle is provided as a service carried out with reasonable skill and care. Beyond that, and to the extent the law allows, we do not make guarantees about results — for example how many customers or enquiries a website will produce.
Limitation of liability
To the extent the law allows, Tonle is not liable for indirect or consequential losses, lost profits, lost business or lost data arising from use of the service.
Nothing in these terms limits liability that cannot be limited by law.
Your content, your responsibility
If a claim is brought against Tonle because of content you asked us to publish — for example a copyright complaint about a photograph — you agree to be responsible for that claim and for reasonable costs arising from it.
Governing law and disputes
These terms are governed by the laws of the Kingdom of Cambodia. Any dispute arising out of or in connection with them will be dealt with by the competent courts of Phnom Penh, Cambodia.
The service is provided by Tonle.co, registered at St 92, Phnom Penh, Cambodia.
Please raise any problem with us directly first — most things are resolved by talking.
Changes to these terms
We may update these terms as the service develops. The date at the top shows the last revision, and we will tell existing customers about significant changes.
